Company Demands Police and Acting Governor Put an End to Protests Led by Independence Activists and Defend Jobs and Economy

The Court of Appeals of the Commonwealth of Puerto Rico yesterday has once again ruled in favor of the Peñuelas Valley Landfill (PVL) and its right to continue use and disposal activities of coal combustion residuals. The ruling denied the motion filed by protestors asking the court to reconsider its order in the case of Peñuelas Valley Landfill, Inc. v. José M. Díaz y otros, et. al., in which the Court had ruled earlier this month that EC Waste had the right to resume coal ash use and disposal without interference.

“We are pleased with the court’s determination that vindicates and protects the operations of a fully compliant business against an entirely political campaign of misinformation and fear. The Court of Appeals again sided with the rule of law and against the illegal blockade led by the Puerto Rico Independence Party. This ruling reaffirms the right of EC Waste to continue in full operations that are performed in protection of the environment and the health of all citizens and communities in Peñuelas. The Government of Puerto Rico cannot let the blockade continue. Our employees, and all the law-abiding citizens of Puerto Rico deserve action”, said Ricardo Soto, spokesman for EC Waste.

EC Waste further alerted the wider business community of Puerto Rico that the continued failure to provide basic legal security to a law-abiding company, under multiple court orders, will certainly tarnish the hope of a smooth return to the financial markets by the next Government of Puerto Rico.

EC Waste is the leading provider of non-hazardous solid waste management and disposal services in the Commonwealth of Puerto Rico. EC Waste employs over 300 employees in Puerto Rico, and provides thousands of indirect jobs. Our services include collection, transfer, disposal, recycling, non-hazardous liquid solidification and resource recovery. The company has several operations and activities including the operations of the Peñuelas Valley Landfill (PVL) and El Coqui Landfill (ECL) in Humacao, two of the only privately owned landfills operating in Puerto Rico. These facilities are managed in full compliance with the strictest industry standards set by the Resource Conservation and Recovery Act (RCRA) of the United States, the Environmental Protection Agency (EPA) and with regular inspections, permits and operations plans approved by Puerto Rico’s Environmental Quality Board (EQB).
